Please read and understand our Terms & Conditions thoroughly before booking a retreat or other experiences with us. you will be asked to agree to these Terms & Conditions to conclude the booking process.


1. Your Booking is a contract

1.1 When you (sometimes referred to as a “client”) book an event with The Joy Project (sometimes referred to as TJP, “we” or “us”), you will be deemed to have agreed to these Terms & Conditions. Moreover, your booking, together with (a) these Terms & Conditions and (b) the details regarding the retreat as listed on our website will constitute a legally binding contract between you and us. The person making the booking must be at least 18 years of age and authorized to do so.

1.2 You acknowledge that your registration extends to all individuals listed in the registration, and as such, you assume liability for both your own contractual obligations and those of the individuals listed.

1.3 We will notify you of the contract's finalization through the issuance of a booking confirmation.

1.4 If you haven't received your booking information, please notify us promptly.

2. Payment

Clients must complete the online registration form and submit a full payment to secure their spot. Payments can be made via credit card.

3. Your Details

To confirm your booking, you must provide us with certain personal information. The types of information we may require include, for example: Full name, copy of passport photo page, date of birth, home address, etc. We adhere to strict confidentiality standards, ensuring that customer details are not disclosed to any third parties. Furthermore, credit card details are not retained for security purposes. For a thorough understanding of our privacy practices, kindly refer to the Privacy Policy and Data Protection detailed in paragraph 14 of our General Terms & Conditions.

4. Amendments to Services

Occasionally, changes may have to be made (e.g., yoga teacher, class times or other arrangements), which we reserve the right to do at any time. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

5. Client Cancellations and Substitute Person

5.1 If you choose to cancel your booking, the refund policy is as follows:

  • Cancellations made more than 60 days before the retreat start date will receive a 75% refund.

  • Cancellations made between 45 and 59 days before the retreat start date will receive a 50% refund.

  • Cancellations made within 45 days of the retreat are non-refundable.

5.2 Bookings are non-transferable unless you find a replacement. However, TJP can decline the substitute if he/she/they don't meet travel requirements or if his/her/their participation violates laws or directives. Both you and the substitute share responsibility for the total trip cost and any extra expenses resulting from the replacement. We strongly recommend that you purchase a travel insurance.

6. Unclaimed Services

In cases where individual services, duly offered to you, remain unused due to early return, illness, or other reasons attributable to you, there is no entitlement to a partial refund.

7. Cancellations made by us

7.1 We reserve the right in any circumstances to cancel a retreat. In particular our retreats require a minimum number of at least 75% of the participants to have booked by 30 days before the start date. If this minimum number is not reached by that date we may cancel and refund the money to you. In the scenario an event is cancelled, you will receive a refund of all payments made toward the booking price minus bank transfer costs.

7.2 In addition, we reserve the right to cancel any event at any time if, due to natural disaster, political instability or other disruptions and/or circumstances beyond our control (“Force Majeure”), the operating of the event would be unsafe or otherwise unviable. In the scenario an event is cancelled due to a Force Majeure, the client will be refunded the amount paid, less any costs incurred by TJP which are not recoverable, including bank transfer costs.

7.2 We reserve the right, in the exercise of our discretion and judgment, to reject or cancel any client booking and/or to deny participation by any client in an event at any time prior to the start date, if we believe that a client poses a risk to the property or external suppliers. If a client booking is rejected or cancelled, then that client will receive a full refund of all monies paid to TJP for that event minus bank transfers costs. Furthermore, each yoga instructor or coach leading an event also has the authority, in the exercise of his/her/their discretion and judgment, to deny participation to any of the guests, if the instructor believes the client’s continued participation will be disruptive to the overall experience, to the other clients and/or to property or suppliers. If a client is denied participation after the event’s start date, there is no entitlement to a refund.

7.3 Clients should not practise yoga or workshops under the influence of alcohol, drugs, or both, and doing so will result in immediate dismissal of the event, with no refund being issued.

8. Health Conditions and Client’s Responsibilities

8.1 Clients must inform us of any pre-existing medical conditions or injuries that may affect their ability to participate in physical activities. Clients are responsible for consulting with a qualified healthcare professional to ensure they are physically and mentally fit to participate in the retreat or any of the other listed experiences provided by TJP. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

8.2 During the first trimester of pregnancy, it is not advisable for individuals who haven't been regular yoga practitioners for several years or have experienced a previous miscarriage to engage in yoga. It is recommended to attend pregnancy yoga classes for the remainder of the pregnancy. If you have been consistently practicing yoga for several years and have consulted with your doctor, participating in our retreats is at your own risk. Please adhere to the instructions provided by our yoga instructors.

8.3 The client must cooperate in the event of service disruptions within the legal provisions, aiming to mitigate damages and minimise them after occurrence.

9. Travel Regulations

9.1 All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the event are at your own cost, unless otherwise specified.

9.2 You are responsible for complying with all regulations essential for the trip's execution. Ensuring the necessary travel documents, including visas, permits, certificates, valid passports or identity cards, is the client's responsibility.

9.3 You should proactively gather information on infection, vaccination protection, and other preventive measures. If necessary, seek medical advice regarding thrombosis and other health risks well in advance of the trip.

9.4 We strongly advise all clients to purchase travel insurance to cover sickness, cancellation or curtailment. Be aware that each client is 100% responsible for any losses, penalties, fees or other financial consequences arising out of any booking or trip, or the cancellation or interruption of any event (including, i.e., costs related to airline tickets and fees, passport fees, visa fees, medical expenses, etc.). For all of these reasons, we urge you to purchase travel insurance promptly following booking of the event.

10. Liability

10.1 We and the involved third parties such as your Yoga Teacher and/or Coach, accept the responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

10.2 We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

10.3 We and the involved parties, are not liable for any injuries you may incur. Yoga classes are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat.

10.4. We and the involved parties cannot be responsible for the individual behavior of any group member or other guest sharing your accommodation.

10.5 We and the involved third parties are not liable for loss of, or damage to, your personal property. The property will not be left empty and unlocked at any time, and you will be given your own personal key to your room. It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment.

10.6 TJP does not own, operate or control any person or entity that provides any goods or services for your event (“Third Party Operators”), including any lodging facilities, airline, ground or water transportation, tour operator, food service provider, etc. Rather, we contract with Third Party Operators to provide all goods and services for your event; and you understand that all Third Party Operators are independent contractors, and not affiliates or employees of TJP. Third Party Operators will be arranged by TJP with suppliers local to the regions in which we curate the events, who may themselves engage the services of other local operators and/or sub-contractors. TJP will at all times endeavour to appoint reputable and competent local suppliers in reference to local laws and regulations in the relevant country of operation. The terms and conditions of the suppliers will be applicable and are expressly incorporated into these Terms, and the client assents to those terms and conditions and the limitations and obligations contained therein. Accordingly, in the absence of gross negligence by TJP, you understand and agree that TJP shall not have any responsibility or liability for any acts or omissions of any Third Party Operators in connection with your event. Without limiting the foregoing, we will not be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss cost or expense you may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason of the acts or omissions of any Third Party Operator.

11. Liability Disclaimer for Third-Party Damage, including Participants

Clients are solely responsible for any damage caused to third-party property, including but not limited to historic buildings, venues, or other suppliers, as well as damages to fellow participants. TJP shall not be held responsible for such damages and will not assume any financial responsibility for the repair or compensation. Participants are strongly advised to have their own insurance coverage to address potential liability issues. In the event of damage, participants are required to handle all financial obligations directly with the affected third party or participant and their insurance providers. TJP disclaims any liability for third-party property damage or damages to other participants resulting from the actions or negligence of participants during the event.

12. Complains

In case you have a complaint during or after an event with us, please notify us immediately. If the issue is not resolved, you must submit your complaint in writing within 7 days of the event's conclusion by emailing us at thejoyproject.it@gmail.com. Complaints received outside this timeframe will not be accepted, indicating your satisfaction with all aspects of the event and our services. We will acknowledge your correspondence within 7 days and strive to address the complaint promptly. To facilitate a thorough investigation, please provide your booking reference and all relevant information. Please note that we cannot accept liability for complaints not following this procedure unless they involve death, personal injury, or illness. Additionally, please be aware that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.

13. Website, Printed Material and Advertising

The information provided in our website, printed material and advertising materials is of the best of our knowledge and we believe it is correct at the time of publishing. Occasionally errors may occur and information may change so you must therefore check all the details at the time of booking.

14. Privacy Policy & Data Protection

14.1 We may collect personal information about you for event operations or to send marketing material related to our event offerings and special promotions. This information may be shared with our partners, service providers, or suppliers to facilitate event operations. Only necessary information for this purpose will be disclosed. Occasionally, we may be required to disclose information for security, terrorism, or other regulatory purposes mandated by governments. This information may be shared with companies acting as data processors on our behalf. Your consent is required for us to collect and use this information. If you do not consent, we cannot accept your booking.

14.2 Before adding participants to a potential Whatsapp group during the event, we will ask for their consent during the event. Your mobile number will not be shared unless you explicitly agree to be part of the group. We collect emergency contact information before every yoga retreat, using it solely for emergency purposes and may share it with relevant parties in case of emergency. By providing this information, you consent to its disclosure.

14.3 We collect your contact details through various means, including website forms, emails, and newsletter sign-ups, and may contact you with information about special offers, future yoga retreats or experiences. If you prefer not to receive such information, please inform us. We do not share your contact information with third-party agencies for marketing purposes.

14.4 You can request a Data Access Request Form to obtain a copy of the information we hold about you, subject to a fee. Requests should be emailed to thejoyproject.it@gmail.com.

14.5 This privacy policy does not cover the links within this site linking to other sites.

15. Miscellaneous

15.1 We may need to make changes to these terms and conditions from time to time. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these terms and conditions without prior notification. If changes are required, we will provide you with a copy of these changes, and all new reservations will follow the updated terms. However, existing reservations will remain subject to the original terms.

15.2 In the event that any of the aforementioned clauses becomes invalid, the remaining conditions will remain in force, and the validity of the booking contract will not be affected. This agreement and the entire contractual and legal relationship between the client and TJP shall be exclusively governed by Swiss law.
